SOMMINISTRAZIONE FRAUDOLENTA: INDICAZIONI OPERATIVE NELLA CIRCOLARE DELL'INL


Con la Circolare n. 3 dell'11 febbraio 2019 l'Ispettorato Nazionale del Lavoro fornisce indicazioni operative sulla nuova fattispecie della somministrazione fraudolenta, reintrodotta dalla L. n. 96/2018, di conversione del D.L. n. 87/2018, che si configura in tutti i casi in cui la somministrazione di lavoro è posta in essere con la specifica finalità di eludere norme inderogabili di legge o di contratto collettivo applicate al lavoratore. L'illecito in questione è punito, oltre che con la sanzione amministrativa (art. 18 D.Lgs. n. 276/2003), con la sanzione penale dell'ammenda di 20 euro per ciascun lavoratore coinvolto e per ciascun giorno di somministrazione. L'INL, con la suddetta circolare, ha fornito ulteriori indicazioni operative al personale ispettivo, anche ad integrazione della recente circolare n. 10 dell'11 luglio 2018 in materia di appalto illecito. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
