LAVORI DI DEMOLIZIONE E RISTRUTTURAZIONE: NIENTE SISMA BONUS SE L'ASSEVERAZIONE è TARDIVA


Con la Risposta n. 64/2019 l'Agenzia delle Entrate ha fornito chiarimenti circa la possibilità di accedere al c.d. "sisma bonus" anche se i lavori di demolizione e ristrutturazione dell'immobile sono stati abilitati attraverso il permesso a costruire e non attraverso una SCIA e anche se non è stata allegata alla presentazione del permesso a costruire in Comune l'asseverazione prevista dalla norma sulla classe di rischio dell'edificio precedente l'intervento e quella conseguibile a seguito dell'esecuzione dell'intervento per l'accesso alla detrazione (che verrà invece presentata successivamente). Le Entrate, nella risposta fornita, inizialmente precisano che il sisma bonus spetta, come previsto dalla norma, per interventi che riguardano "il consolidamento delle parti strutturali di edifici o complessi di edifici esistenti" e che le modalità di attestazione, da parte di professionisti abilitati, dell'efficacia degli interventi realizzati e la classificazione del rischio sismico delle costruzioni sono state definite dal D.M n. 58/2017. In particolare: l'articolo 3, comma 2 del D.M. prevede che sia il progettista dell'intervento strutturale ad asseverare la classe di rischio dell'edificio precedente l'intervento e quella conseguibile dopo l'intervento; l'articolo 3, comma 3 stabilisce che il progetto per la riduzione del rischio sismico, contenente l'asseverazione di cui al comma 2, deve essere allegato alla segnalazione certificata di inizio attività, da presentare allo sportello unico competente; l'articolo 3, comma 4 prevede inoltre che il direttore dei lavori e il collaudatore statico, a ultimazione dei lavori attestano la conformità degli interventi eseguiti al progetto depositato, come asseverato dal progettista; l'articolo 3, comma 5 stabilisce, infine, che l'asseverazione e suddette attestazioni vanno depositate presso lo sportello unico e consegnate in copia al committente, per l'ottenimento dei benefici fiscali previsti dall'articolo 16, comma 1-quater, del citato decreto-legge n. 63 del 2013. Alla luce di quanto richiamato, dunque, "la non contestuale/tardiva allegazione del progetto degli interventi per la riduzione del rischio sismico contenente l'asseverazione non consente l'ottenimento dei benefici fiscali".
