Agevolazione sugli interventi di ristrutturazione edilizia e riqualificazione energetica riconosciuta anche in caso di bonifico "non parlante"


Il pagamento delle spese riferite a interventi di ristrutturazione edilizia e riqualificazione energetica di edifici esistenti è soggetto a ritenuta ai sensi dell'art. 25 del d.l. 78/2010. La risoluzione n. 55/E del 2012 aveva precisato che, in caso di bonifico non completo e predisposto in modo tale da non permettere l'applicazione della ritenuta, il beneficio era comunque applicabile attraverso la ripetizione del bonifico corretto. La circolare 43/E/2016 era nuovamente intervenuta sul punto, evidenziando che nel caso in cui il bonifico fosse stato predisposto in modo tale da non consentire alle banche e a Poste italiane di adempiere correttamente all'obbligo di ritenuta e non fosse stata possibile la ripetizione del bonifico era comunque possibile usufruire dell'agevolazione, a condizione che il beneficiario della disposizione di pagamento attestasse con una dichiarazione sostitutiva di atto notorio "di aver ricevuto le somme e di averle incluse nella contabilità dell'impresa ai fini della loro concorrenza alla corretta determinazione del suo reddito". L'Agenzia delle Entrate, con la circolare n. 8 del 7 aprile 2017, conferma che tale soluzione si applica al caso di bonifico ordinario (cosiddetto "non parlante"), in quanto la fruizione del beneficio fiscale non può essere esclusa quando è stata comunque raggiunto lo scopo delle norme agevolative in questione, vale a dire la corretta tassazione del reddito riferito allo svolgimento opere di ristrutturazione edilizia e riqualificazione energetica. Viene comunque ribadito che il beneficio ordinariamente si ottiene mediante effettuazione del pagamento mediante bonifico specifico (cosiddetto bonifico "parlante").
