IMU E CASA CONIUGALE: IL DIRITTO DI ABITAZIONE NON SI ESTINGUE CON LA MAGGIORE ETà DEI FIGLI


Il diritto di abitazione sulla casa familiare assegnata in sede di separazione o divorzio non si estingue automaticamente con il raggiungimento della maggiore età dei figli, con conseguente mantenimento del regime agevolativo ai fini dell?"IMU. Lo ha stabilito la Corte di Giustizia Tributaria di primo grado di Prato, con la Sentenza n. 55 del 17 marzo 2026, chiarendo che il genitore collocatario non perde automaticamente il diritto all?"assegnazione dell?"immobile al venir meno della minore età dei figli. Nel caso esaminato, il Comune aveva richiesto il pagamento dell?"IMU al proprietario del 50% dell?"immobile, ritenendo cessato il diritto di abitazione dell?"ex coniuge assegnatario della casa familiare una volta raggiunta la maggiore età dei figli. Tuttavia, i giudici hanno ritenuto tale impostazione illegittima.Secondo la Corte, in assenza di una disposizione normativa che preveda espressamente la cessazione del diritto di abitazione, l?"ente locale non può modificare unilateralmente una situazione giuridica già definita da un provvedimento giudiziale di assegnazione dell?"immobile, dal quale non risultava alcun termine legato alla maggiore età dei figli. La decisione ribadisce quindi che l?"assegnazione della casa familiare continua a produrre effetti fino a quando non intervenga un diverso provvedimento del giudice o una specifica causa di cessazione prevista dalla legge.
