AMMINISTRATORI DI S.R.L. SENZA DIPENDENTI E ISCRIZIONE ALL?"INAIL


La figura dell?"amministratore di S.r.l. priva di dipendenti genera spesso dubbi interpretativi circa la necessità di attivare una posizione assicurativa INAIL. Contrariamente a quanto si possa pensare, l?"iscrizione non è un automatismo legato alla carica, ma una conseguenza della natura del rischio a cui il soggetto è effettivamente esposto durante la sua attività.   L?"amministratore deve essere assicurato solo se svolge un?"attività che rientra tra quelle “protette”. Questo accade quando l?"amministratore non si limita ad atti puramente gestionali (firmare documenti, partecipare a decisioni strategiche), ma esegue prestazioni d?"opera manuale o tecnico-operativa. L?"obbligo scatta in particolare quando l?"amministratore: utilizza macchinari o attrezzature in modo non occasionale; guida veicoli per conto della società (rischio strada); usa il computer (macchina elettrica) in maniera continuativa o sistematica.   L?"uso del computer è il punto di maggiore attrito durante le verifiche ispettive. La giurisprudenza e la prassi INAIL chiariscono che: l?"uso sporadico del PC per consultare l?"estratto conto bancario o rispondere a email istituzionali è considerato “meramente occasionale” e non genera obbligo assicurativo; se l?"amministratore gestisce personalmente la contabilità, redige progetti tecnici con software specifici o trascorre diverse ore al giorno davanti al terminale, il rischio infortunistico si configura invece pienamente, rendendo necessaria l?"apertura della PAT (Posizione Assicurativa Territoriale).   Un distinguo fondamentale riguarda poi la natura della società: per la S.r.l. Artigiana vige un regime di maggior rigore. Il socio-amministratore che partecipa attivamente al lavoro è sempre soggetto all?"obbligo INAIL, in quanto la sua opera è elemento essenziale della natura artigiana dell?"impresa; per le S.r.l. di servizi o immobiliari, se l?"amministratore delega l?"operatività a terzi e svolge solo compiti intellettuali di alta amministrazione, l?"esenzione è la regola.   Per gli amministratori che rientrano nell?"obbligo, il premio si calcola sulla base di retribuzioni convenzionali che vengono aggiornate annualmente dall?"INAIL.   Nota bene: la voce di rischio più comune per le attività d?"ufficio è la 0722, ma è fondamentale che la descrizione dell?"attività nella denuncia d?"esercizio corrisponda esattamente alle mansioni svolte per evitare contestazioni in caso di infortunio.   Concludendo dunque, la valutazione deve essere effettuata caso per caso, analizzando il “diario quotidiano” dell?"amministratore. In un contesto di controlli sempre più digitalizzati, è opportuno che la scelta di non assicurare l?"amministratore sia supportata da una documentazione interna che ne attesti l?"attività puramente intellettuale.

  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
