TRASPORTO RIFIUTI E IVA: CHIARIMENTI DELL?"AGENZIA SULLE NUOVE REGOLE POST LEGGE DI BILANCIO 2025


Il trattamento fiscale dei costi legati alla gestione dei rifiuti, ed in particolare delle prestazioni di trasporto, continua a sollevare dubbi operativi tra gli operatori del settore, alla luce delle recenti modifiche normative. Con Risposta a consulenza giuridica n. 6 del 17 marzo l?"Agenzia delle Entrate è intervenuta su un?"istanza presentata da un?"associazione rappresentativa del comparto trasporto e logistica, volta a chiarire l?"ambito applicativo dell?"aliquota IVA agevolata del 10% dopo le modifiche introdotte dalla Legge di Bilancio 2025, che hanno escluso l'applicazione dell'imposta ridotta per le operazioni di "conferimento in discarica e l?"incenerimento privo di recupero efficiente di energia di rifiuti urbani e rifiuti speciali", per assoggettarle, a decorrere dal 1° gennaio 2025, all'aliquota IVA ordinaria del 22%.In particolare, venivano prospettati tre casi relativi al trasporto di rifiuti urbani e speciali, destinati sia al recupero sia allo smaltimento, con dubbi sulla corretta aliquota IVA da applicare al servizio, soprattutto quando i rifiuti sono diretti in discarica (D1). Richiamando anche i chiarimenti forniti dal Ministero dell?"Ambiente e della Sicurezza energetica, l?"Agenzia ha ribadito che il trasporto dei rifiuti costituisce un?"operazione autonoma ricompresa nell?"ambito della “gestione dei rifiuti” e, come tale, beneficia dell?"aliquota IVA agevolata del 10%. In tale ambito, non assumono rilievo né la causale indicata nel formulario rifiuti (FIR) né la destinazione finale degli stessi, poiché la qualificazione ai fini IVA dipende esclusivamente dalla natura della prestazione resa. L?"esclusione dall?"agevolazione introdotta dalla Legge di Bilancio 2025, concludono le Entrate, riguarda esclusivamente le operazioni di conferimento in discarica e incenerimento senza recupero energetico (D1, D10 e D11), ma non si estende alle attività di trasporto, anche se funzionalmente collegate a tali operazioni.
