FORMAZIONE GESTORI DELLA CRISI: CHIARIMENTI CNDCEC SUI 40 CREDITI INIZIALI E AGGIORNAMENTO BIENNALE


Nel Pronto Ordini n. 128/2025 il Consiglio Nazionale dei Dottori Commercialisti e degli Esperti Contabili (CNDCEC) fornisce chiarimenti in materia di formazione per la successiva iscrizione nell?"Elenco dei gestori della crisi, ai sensi dell'art. 356 del Codice della crisi d?"impresa e dell?"insolvenza (CCII). In particolare, il CNDCEC risponde da un quesito posto del Consiglio dell?"Ordine dei Dottori Commercialisti e degli Esperti Contabili di Torino, relativo alla possibilità di acquisire i 40 crediti formativi, necessari per la formazione iniziale e successiva prima iscrizione nell?"Elenco, tramite la frequenza di differenti corsi di formazione che rispettano quanto disposto dalle Linee Guida generali elaborate dalla Scuola Superiore della Magistratura ed aggiornate alla data del 1° febbraio 2023. Formazione iniziale obbligatoriaLa formazione iniziale per l?"iscrizione nell?"Elenco dei gestori della crisi, spiega il CNDCEC, deve essere completata tramite un unico corso di perfezionamento conforme alle linee guida della Scuola Superiore della Magistratura. Il corso, erogato da università o da soggetti convenzionati come camere di commercio e ordini professionali, deve essere concluso prima della presentazione della domanda, con eventuale titolo finale conseguito. Il completamento va documentato tramite certificazione ufficiale o dichiarazione sostitutiva, indicando ente erogatore, durata del corso (minimo 40 o 200 ore a seconda della qualifica del professionista) e data di conclusione. Non è possibile ottenere i 40 crediti richiesti sommando più corsi differenti. Aggiornamento biennalePer quanto riguarda l?"aggiornamento biennale, i professionisti iscritti agli Ordini di Avvocati, Dottori Commercialisti ed Esperti Contabili e Consulenti del lavoro devono completare 18 ore di formazione ogni due anni. Questo obbligo può essere assolto anche combinando più corsi o convegni, purché la durata complessiva raggiunga almeno 18 ore. I corsi equipollenti, secondo i criteri stabiliti dal CNDCEC con l?"Informativa n. 48 del 28 marzo 2025, devono avere una durata minima di 6 ore. Inoltre, gli Ordini professionali hanno facoltà di definire ulteriori criteri di equipollenza con la formazione professionale continua, per consentire ai professionisti di organizzare il proprio aggiornamento biennale in modo flessibile.
