TELEFONIA AZIENDALE: QUANDO I COSTI SONO DEDUCIBILI AL 100% (RISPOSTA N. 71/2026)


Nuovi chiarimenti sul trattamento fiscale dei costi di telefonia quando sono sostenuti nell?"ambito di servizi resi ai clienti. Con Risposta a interpello n. 71 del 9 marzo l'Agenzia delle Entrate ha chiarito che i costi telefonici che costituiscono un fattore produttivo direttamente impiegato per erogare servizi ai clienti, e quindi correlati a ricavi integralmente imponibili, non sono soggetti al limite di deducibilità dell?"80% previsto dall?"articolo 102, comma 9, del TUIR, ma risultano integralmente deducibili secondo le regole ordinarie di determinazione del reddito d?"impresa. Resta invece applicabile il limite dell?"80% per le spese relative alla quota di autoconsumo o comunque suscettibili di utilizzo promiscuo.  Nella Risposta l?"Agenzia precisa che le medesime conclusioni valgono anche per i costi sostenuti dalle stabili organizzazioni estere della società, qualora concorrano alla produzione di ricavi imponibili in Italia secondo il principio della tassazione mondiale (c.d. worldwide income taxation). Il chiarimento arriva a seguito del quesito posto da una società italiana che fornisce servizi informatici e di procurement alle altre società del gruppo, anche tramite proprie stabili organizzazioni all?"estero. Nell?"ambito dei contratti di servizio, la società sostiene costi per telefonia fissa, mobile e trasmissione dati, in parte utilizzati internamente e in parte integrati nei servizi resi ai clienti.Poiché l?"impresa è in grado di distinguere analiticamente i costi sostenuti per l?"autoconsumo da quelli direttamente riferibili ai servizi erogati ai clienti, l?"Agenzia riconosce che solo i primi restano soggetti alla limitazione di deducibilità prevista dal TUIR, mentre i secondi possono essere dedotti integralmente, in quanto direttamente collegati alla produzione dei ricavi.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
