MILLEPROROGHE 2026: SLITTA AL 15 DICEMBRE L?"AGGIORNAMENTO CATASTALE DELLE STRUTTURE RICETTIVE ALL?"APERTO


Prorogato di un anno il termine per gli adempimenti catastali connessi all?"esclusione degli allestimenti mobili dalla rendita delle strutture ricettive all?"aperto. Sulla Gazzetta Ufficiale n. 49 del 28 febbraio è stata pubblicata la Legge 27 febbraio 2026 n. 26, di conversione in legge, con modificazioni, del decreto-legge 31 dicembre 2025, n. 200, recante disposizioni urgenti in materia di termini normativi (c.d. Decreto Milleproroghe). La legge è entrata in vigore lo scorso 1° marzo. Tra le novità in materia fiscale la conferma della proroga, al 15 dicembre 2026, per l?"aggiornamento catastale degli intestatari di strutture ricettive all?"aperto a seguito dell?"irrilevanza degli allestimenti mobili. L?"articolo 7-quinquies del Dl n. 113/2024 ha previsto l?"esclusione, ai fini catastali, degli allestimenti mobili installati presso le strutture ricettive all?"aperto. In particolare, a decorrere dal 1° gennaio 2025, case mobili, maxi-caravan e analoghe unità destinate al pernottamento non concorrono più alla determinazione della rendita catastale, in quanto non rilevanti ai fini del censimento e della rappresentazione in catasto.Contestualmente, la norma ha disposto una rivalutazione del valore delle aree su cui insistono tali strutture: ai fini della stima della rendita catastale, il valore delle aree attrezzate è incrementato dell?"85% rispetto a quello ordinariamente attribuito sul mercato, mentre per le aree non attrezzate destinate al pernottamento l?"incremento è pari al 55%. Dal 1° gennaio 2025, i soggetti intestatari catastali delle strutture ricettive all?"aperto sono quindi tenuti a presentare gli atti di aggiornamento geometrico per l?"adeguamento della cartografia catastale, nonché gli atti di aggiornamento al Catasto fabbricati secondo le modalità previste dalla normativa vigente. In sede di conversione del decreto è stata confermata la proroga del termine per tali adempimenti, differito dal 15 dicembre 2025 al 15 dicembre 2026.
