INVESTIMENTI ZES UNICA E ZLS: PRONTI I MODELLI PER COMUNICARE LE SPESE SOSTENUTE NEL TRIENNIO 2026-2028


La Legge di bilancio 2026 ha rafforzato il sistema degli incentivi fiscali destinati alle aree svantaggiate del Paese, ampliando i crediti d?"imposta per gli investimenti nella Zona economica speciale (Zes unica) e nelle Zone logistiche semplificate (Zls) ed estendendo le agevolazioni agli anni 2026, 2027 e 2028.  Con due distinti provvedimenti datati 30 gennaio l?"Agenzia delle Entrate ha approvato i nuovi modelli di comunicazione e comunicazione integrativa per fruire dei suddetti benefici fiscali, approvando anche le relative istruzioni e modalità di trasmissione telematica. Si tratta, in particolare: dei modelli di comunicazione per l?"utilizzo del contributo riconosciuto sotto forma di credito d?"imposta per gli investimenti realizzati dal 1° gennaio al 31 dicembre degli anni 2026, 2027 e 2028 nella Zona economica speciale per il Mezzogiorno (“ZES unica”), che le imprese devono utilizzare per comunicare i dati relativi agli investimenti effettuati negli anni 2026, 2027 e 2028 relativi al credito d?"imposta ZES unica; dei modelli di comunicazione per l?"utilizzo del contributo sotto forma di credito d?"imposta per gli investimenti realizzati dal 1° gennaio al 31 dicembre degli anni 2026, 2027 e 2028 nelle Zone Logistiche Semplificate (di seguito, “ZLS”), che le imprese devono utilizzare per comunicare i dati relativi agli investimenti effettuati negli anni 2026, 2027 e 2028 relativi al credito d?"imposta ZLS. I modelli di "Comunicazione" e "comunicazione integrativa"Con la "comunicazione" (art. 1, comma 439 L. n. 199/2025 primo periodo) gli operatori economici devvono indicare l?"ammontare delle spese ammissibili sostenute dal 1° gennaio e quelle che prevedono di sostenere fino al 31 dicembre dell?"anno di riferimento, relative all?"acquisizione di beni strumentali destinati a strutture produttive già esistenti o che vengono impiantate nella ZES unica.Con la "Comunicazione integrativa" (art. 1, comma 439 L. n. 199/2025, secondo periodo) gli stessi operatori economici, a pena di decadenza dall'agevolazione, devono attestare l?"avvenuta realizzazione, entro il 31 dicembre dell?"anno di riferimento (2026, 2027 o 2028), degli investimenti indicati nella Comunicazione precedentemente inviata. Tale ultima Comunicazione non deve indicare un ammontare di investimenti superiore a quello riportato nella precedente. Per la Zls, devono essere indicati anche gli acconti versati e fatturati dall?"8 maggio 2024 (o dalla data del Dpcm istitutivo o modificativo della Zls) e le spese relative a investimenti pluriennali avviati dal 2024.   • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
