BONUS DIPENDENTI FINO A 20.000 EURO: CONTANO SOLO I GIORNI RETRIBUITI


Chiarimenti dell?"Agenzia delle Entrate sul calcolo dei giorni di lavoro dipendente rilevanti per la determinazione della somma integrativa prevista dalla legge di bilancio 2025. Con Risposta ad interpello n. 7 del 16 gennaio l'Agenzia delle entrate fornisce due importanti chiarimenti in merito alla corretta individuazione dei "giorni di lavoro dipendente" da utilizzare per il calcolo del "reddito annuale teorico", ai sensi dell'art. 1, commi 4 e 5, della Legge di bilancio 2025, che riconosce una somma integrativa ai titolari di reddito di lavoro dipendente con reddito complessivo non superiore a 20.000 euro, determinata applicando specifiche percentuali al reddito percepito, previa individuazione del reddito annuale teorico, rapportato all?"intero anno. L?"istanza è stata presentata da un?"Azienda sanitaria locale, in qualità di sostituto d?"imposta, che ha chiesto come debbano essere conteggiati i giorni di lavoro nel caso in cui il dipendente, pur formalmente in forza, non abbia percepito retribuzione per alcune giornate dell?"anno a causa, ad esempio, di aspettative, permessi non retribuiti o sospensioni dal servizio. In particolare, il quesito riguardava due ipotesi: l?"assenza parziale di giorni retribuiti nel corso dell?"anno e l?"assenza totale di giorni lavorati, a fronte della corresponsione di somme non collegate alla presenza in servizio. Con riferimento al primo caso, l?"Agenzia ha chiarito che, ai fini del calcolo del reddito annuale teorico, i “giorni di lavoro dipendente” da considerare sono esclusivamente quelli per i quali il lavoratore ha effettivamente percepito una retribuzione, dovendosi escludere le giornate prive di qualsiasi emolumento, anche sotto forma di retribuzione differita.Diversamente, nell?"ipotesi di assenza totale di giorni lavorati nell?"anno, qualora siano corrisposte somme che non si riferiscono all?"attività svolta nel periodo d?"imposta (come arretrati o competenze accessorie), l?"Agenzia ha ritenuto che non spetti alcuna somma.
