GLOBAL MIMINUM TAX: LE LINEE GUIDA DEL MEF PER LA COMUNICAZIONE RILEVANTE


Sul sito internet del MEF (Dipartimento delle Finanze) sono state pubblicate le linee guida in materia di imposizione minima globale (Global Minimum Tax), introdotta con il D.lgs n. 209/2023, che contengono relativi alla compilazione della Comunicazione Rilevante. Con il Decreto ministeriale del 16 ottobre 2025 è stato recepito in Italia il modello standard europeo di Comunicazione Rilevante, contenuto nella Direttiva (UE) 2025/872, che modifica la direttiva 2011/16/UE relativa alla cooperazione amministrativa nel settore fiscale (DAC 9).Il modello risponde all?"esigenza di garantire un set comune di informazioni ed un approccio coerente ed uniforme in tutti i Paesi che hanno implementato la Global minimum tax nel loro ordinamento, e facilita l?"adempimento dei grandi gruppi multinazionali nei diversi Paesi in cui operano.Il legislatore italiano, per garantire massima coerenza ed uniformità al sistema dell?"imposizione integrativa, ha deciso di adottare il medesimo modello standard anche per i gruppi nazionali che sono soggetti alle disposizioni del Titolo II del D.lgs n. 209/2023. Le Linea Guida, in particolare, fanno riferimento al Modello tipo di cui all?"Allegato 1 del Decreto del 16 ottobre 2025, che identifica i dati rilevanti ai fini della global minimum tax, ossia i dati e le informazioni di cui un?"amministrazione fiscale ha bisogno per eseguire un?"adeguata valutazione del rischio e per valutare la correttezza dell?"obbligazione tributaria dei gruppi multinazionali o nazionali in scope. Dopo una breve descrizione sul funzionamento delle singole sezioni del modello, vengono forniti chiarimenti sulle informazioni/dati da inserire nelle tabelle contenute, sulla base delle indicazioni riportate dal Quadro Inclusivo sul BEPS. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
