AGENZIA ENTRATE: TASSAZIONE MAGGIORAZIONI 2025 PER FONDI PENSIONE ANTE-2007


Con Risposta n. 245 del 16 settembre l'Agenzia delle Entrate ha chiarito il trattamento fiscale delle somme corrisposte agli iscritti a un fondo pensione di un gruppo bancario che avevano esercitato l?"opzione di capitalizzazione delle prestazioni. Il caso riguardava i pensionati cessati dal servizio entro il 31 dicembre 2006, ai quali nel 2021 era stata liquidata una prestazione in forma capitale, già tassata secondo il regime vigente. Successivamente, nel 2023, è stata prevista un?"ulteriore “maggiorazione individuale” da corrispondere nel 2025 e il fondo chiedeva se tale somma dovesse essere trattata come nuova prestazione soggetta alle regole introdotte dal d.lgs. 252/2005 oppure come parte delle prestazioni maturate prima del 2007.  L?"Agenzia ha confermato che la maggiorazione deriva da prestazioni maturate anteriormente al 1° gennaio 2007 e resta quindi soggetta alla disciplina previgente, con tassazione separata ai sensi dell?"articolo 17, comma 1, lettera a), del TUIR. L?"aliquota interna deve essere determinata secondo l?"articolo 19 TUIR, sommando l?"importo della maggiorazione 2025 a quello già erogato nel 2021 e considerando l?"intera anzianità maturata fino alla cessazione del servizio; dall?"imposta complessiva andrà poi detratta quella già applicata alle somme liquidate nel 2021.   • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
