SOCIETà IN AMMINISTRAZIONE STRAORDINARIA: ACCORDO TRA AGENZIA ENTRATE E FINTECNA SPA


E' stato firmato un protocollo d'intesa tra Vincenzo Carbone, direttore dell?"Agenzia delle Entrate, e Antonino Turicchi, amministratore delegato di Fintecna, società del Gruppo Cassa Depositi e Prestiti (CDP).L?"accordo, si legge nel Comunicato dell'Agenzia, punta a rendere più efficiente la gestione delle procedure di Amministrazione straordinaria affidate a Fintecna, con particolare attenzione alla soddisfazione dei crediti fiscali verso l?"Erario. In base all?"intesa, Agenzia e Fintecna collaboreranno per semplificare e velocizzare le operazioni legate a queste procedure, nelle quali Fintecna ricopre o ricoprirà il ruolo di Commissario Straordinario. Nell?"ambito della normativa sulle Amministrazioni straordinarie (DL n. 118/2021), è stato infatti codificato il principio secondo cui il ruolo di Commissario può essere affidato anche a una persona giuridica, come Fintecna, per esigenze di razionalizzazione, celerità e urgenza. In questo quadro, la costituzione di una cabina di regia tra Agenzia delle Entrate e Fintecna consentirà di condividere soluzioni operative alle questioni fiscali, così da accelerare la definizione delle procedure. Un aspetto centrale riguarda i crediti di natura fiscale, che rappresentano spesso la parte principale dell?"attivo nelle Amministrazioni straordinarie. La loro gestione è complessa, richiede talvolta garanzie fideiussorie e incide direttamente sulla possibilità di procedere ai piani di riparto.   • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
