Cass. 21 luglio 2025, n. 20415. Sdoganati i patti prematrimoniali: un'opportunità i notai e altri professionisti, pazienti


Temi, dea dell’ordine cosmico e, non a caso, della giustizia, come tutti gli dei aveva un punto di forza: l’ascolto.Merce rara, oggi, quell’ascolto profondo, che mette in sintonia con l’altro, che alla fine ti chiede: tu che cosa faresti al mio posto? Come notaio mi chiedo:  che cosa farei al posto di quella giovane coppia se avessi la loro età esperienza ed entusiasmo? Mi butterei senza rete, ok.Ma con un po’ di esperienza della vita e di cultura giuridica posso tessere per loro un paracadute, un accordo prematrimoniale; magari non servirà, ma intanto farà chiarezza tra loro, costruiranno il futuro su fondamenta più solide. La Corte di Cassazione in questi giorni (Cass. 21 luglio 2025, n. 20415) ha sdoganato la validità di questi accordi, purché non incidano sui diritti dei minori, e aiutato i professionisti a muoversi con più agilità. Soprattutto i notai, quando la casa viene pagata da entrambi ma intestata solo a un partner,  per godere di agevolazioni fiscali o di interessi privilegiati sui mutui, o quando all’acquisto partecipano genitori, suoceri, amici, rete preziosa, soprattutto per chi è in Italia da poco.  Spesso con scritture private (piace chiamarle side letters, perché accompagnano il rogito), si prefigurano e regolano scenari che si presenteranno solo se il legame verrà sciolto, con impegni a trasferire, patti fiduciari, procure irrevocabili. Senza fretta, tessendo pazientemente quel rapporto di fiducia ed empatia di cui abbiamo tutti un disperato bisogno, insostituibile da App e AI, e prezioso, più di qualche euro apparentemente risparmiato con professionisti frettolosi e … “performanti”.

The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
