CARTELLA NULLA SENZA ESITO DEL CONTROLLO, ANCHE SENZA COLLABORAZIONE


La cartella di pagamento è nulla senza comunicazione dell?"esito del controllo, anche se il contribuente non collabora all?"istruttoria. Con Ordinanza n. 16163 del 16 giugno la Corte di Cassazione, esprimendosi in tema di imposte sui redditi, ha ribadito che la cartella di pagamento che non sia preceduta dalla comunicazione dell'esito del controllo ex art. 36 ter del D.P.R. 29 settembre 1973, n. 600, è nulla, in quanto tale comunicazione assolve ad una funzione di garanzia e realizza la necessaria interlocuzione tra l'Amministrazione finanziaria ed il contribuente prima dell'iscrizione al ruolo, in ciò differenziandosi dalla comunicazione della liquidazione della maggiore imposta ex art. 36 bis dello stesso decreto, che avviene all'esito di un controllo meramente cartolare ed ha il solo scopo di evitare al contribuente la reiterazione di errori e di consentirgli la regolarizzazione di aspetti formali, per cui l'eventuale omissione non incide sull'esercizio del diritto di difesa e non determina alcuna nullità.  Ne consegue che, anche quando il contribuente non collabori all'istruttoria attivata dall'amministrazione nelle forme di cui all' art. 36 ter, comma 3, del D.P.R. n. 600 del 1973, a lui va data comunque comunicazione dell'esito del controllo formale, ai sensi del comma 4 del richiamato articolo, prima dell'emissione della cartella di pagamento, a pena di nullità della stessa.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
