PARTECIPAZIONE DEI LAVORATORI ALLA VITA D?"IMPRESA: LA LEGGE IN GAZZETTA UFFICIALE


Sulla Gazzetta Ufficiale n.  120 del 26 maggio è stata pubblicata la Legge n. 76 del 15 maggio 2025 recante disposizioni per la partecipazione dei lavoratori alla gestione, al capitale e agli utili delle imprese. La legge, in particolare, disciplina la partecipazione gestionale, economica e finanziaria, organizzativa e consultiva dei lavoratori alla gestione, all'organizzazione, ai profitti e ai risultati nonché alla proprietà delle aziende e individua le modalità di promozione e incentivazione delle suddette forme di partecipazione, con l'obiettivo di rafforzare la collaborazione tra i datori di lavoro e i lavoratori, di preservare e incrementare i livelli occupazionali e di valorizzare il lavoro sul piano economico e sociale. Introduce inoltre norme finalizzate all'allargamento e al consolidamento di processi di democrazia economica e di sostenibilità delle imprese. In materia di distribuzione degli utili l'Art. 5 prevede che, per l'anno 2025, in caso di distribuzione ai lavoratori dipendenti di una quota degli utili di impresa non inferiore al 10% degli utili complessivi, effettuata in esecuzione di contratti collettivi aziendali o territoriali, il limite dell'importo complessivo soggetto all'imposta sostitutiva sia elevato, da 3.000 euro, a 5.000 euro lordi. Relativamente, invece, ai piani di partecipazione finanziaria dei lavoratori, l'Art. 6 prevede che nelle aziende possano essere previsti piani di partecipazione finanziaria dei lavoratori dipendenti che possono prevedere, oltre agli strumenti di partecipazione dei lavoratori al capitale della società, anche l'attribuzione di azioni  in sostituzione di premi di risultato.Per il 2025 i dividendi corrisposti ai lavoratori e derivanti dalle azioni attribuite in sostituzione di premi di risultato, per un importo non superiore a 1.500 euro annui, sono esenti dalle imposte sui redditi per il 50% del loro ammontare.   • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
