Privacy - Consiglio Nazionale Forense: i messaggi WhatsApp sono prova


Il consiglio nazionale forense con sentenza R.G. n 2/.22  R.D. 376/2024 ha stabilito che i messaggi whatsapp costituiscono prova.  Tutto è nato dal ricorso proposto dall’avvocato ricorrente al quale il Consiglio Disciplinare del Veneto aveva inflitto la sospensione dall’esercizio della professione per due mesi.  L’avvocato ricorrente era stato accusato dei seguenti capi di imputazione “a) Violazione degli articoli 26 comma 3, 27 comma 6 del C.D.F. per non aver svolto alcuna attività inerente all'incarico di gestione del contenzioso relativo alla causa di separazione giudiziale del signor [AAA], anzi fornendo allo stesso false informazioni circa l'intervenuto deposito del ricorso e lo stato della pratica e per non aver adempiuto nei confronti del sig. [AAA] all'impegno, assunto tramite messaggi del 22 marzo 2018 e 30 marzo 2018, di restituire la somma di € 700,00 ricevuta a titolo d'acconto per la pratica di separazione, senza che alcuna attività fosse stata poi in effetti svolta;  b) Violazione dell'art. 16 CDF per non aver emesso la fattura in relazione agli acconti, per complessivi € 700,00, ricevuti dal sig. [AAA] tramite bonifico bancario (b.b. di € 200 in data 24/8/2017 e b.b. di € 500 in data 16 ottobre 2017); In Vicenza, dall'agosto 2017 e fino al mese di marzo 2018.” Il cliente aveva inoltrato un esposto all’ordine degli Avvocati, lamentando, appunto quanto sopra indicato al punto a); l’avvocato con più messaggi assicurava di aver depositato il ricorso ma il cliente accertava che non era stato depositato e chiedeva la restituzione di quanto corrisposto.  Il Consiglio di Disciplina, giudice della deontologia, ha ampio potere discrezionale nel valutare la conferenza e la rilevanza delle prove dedotte in virtù? del principio del libero convincimento, con la conseguenza che la decisione assunta in base alle testimonianze ed agli atti acquisiti in conseguenza degli esposti deve ritenersi legittima, allorquando risulti coerente con le risultanze documentali acquisite al procedimento (tra le tante, Consiglio Nazionale Forense, sentenza n. 81 del 28 aprile 2021). Per la giurisprudenza di legittimità “i messaggi ‘whatsapp’ e gli sms conservati nella memoria di un telefono cellulare hanno natura di documenti ai sensi dell’art. 234 cod. proc. pen., sicché è legittima la loro acquisizione mediante mera riproduzione fotografica, non trovando applicazione né la disciplina delle intercettazioni, né quella relativa all’acquisizione di corrispondenza di cui all’art. 254 cod. proc. pen., non versandosi nel caso di captazione di un flusso di comunicazioni in corso, bensì nella mera documentazione ‘ex post’ di detti flussi” (Cass. Sez. Pen. 3, n. 8332 del 05/11/2019, dep. 02/03/2020). Pertanto, nei processi innanzi l’autorità giudiziaria penale, è considerata legittima l’acquisizione come documento di messaggi sms o whatsapp inviati dall’imputato sul telefono cellulare della madre della persona offesa e da questa fotografati e consegnati alla polizia giudiziaria, mediante la realizzazione di una fotografia dello schermo di un telefono cellulare sul quale gli stessi sono leggibili.
