CONSULENZE PER IMMOBILI IN ITALIA: L?"IVA SI APPLICA NEL TERRITORIO NAZIONALE


Nella Risposta n. 65 del 4 marzo l'Agenzia delle Entrate affronta il tema della territorialità Iva delle prestazioni consulenziali relative ad un immobile situato in Italia, a seguito della richiesta presentata da una contribuente, nata e residente in Argentina, che intende procedere alla vendita dell'immobile di proprietà situato in Italia, che ha incaricato un'agenzia di intermediazione immobiliare per la vendita del cespite e si è rivolta ad un professionista per curare una trattativa extragiudiziale per la cancellazione di un debito ipotecario gravante sullo stesso immobile. La contribuente, precisando che i suddetti consulenti sono fiscalmente residenti Italia, chiede si sapere, in quanto iscritta all'AIRE, se è tenuta al pagamento pagamento dell'imposta sul valore aggiunto (Iva) relativamente alle prestazioni di servizi erogate da questi nei suoi confronti. L'Agenzia Entrate, in via preliminare, ricorda che in materia di territorialità Iva la regola generale contenuta nell'articolo 7­-ter del Decreto Iva prevede che l'imposta sia dovuta nello Stato in cui è stabilito il committente (rapporti B2B) ovvero il prestatore (rapporti B2C).Tuttavia, il legislatore ha stabilito delle deroghe a questa normativa, in particolare per determinate tipologie di prestazioni di servizi, in relazione alle quali il legislatore, al fine di stabilire il luogo in cui si applica l'imposta, valorizza ulteriori elementi come, ad esempio, la natura del servizio e/o la modalità ed il luogo di esecuzione dello stesso. Con riferimento al caso specifico oggetto dell'interpello, l'Agenzia ha chiarito chele prestazioni di servizi legati a beni immobili, come le attività di intermediazione nella vendita e la consulenza legale per la cancellazione di un?"ipoteca, devono essere tassate nel Paese in cui è ubicato l'immobile.
