DAL 2025 I RIMBORSI PER IL DISTACCO DEL PERSONALE SOGGETTI A IVA


Con Risposta n. 38 del 18 febbraio l'Agenzia delle Entrate fornisce chiarimenti in merito al trattamento IVA relativo ai distacchi e/o prestiti tra imprese, in seguito all?"abrogazione dell?"art. 8, comma 35, della Legge 67/1988, avvenuta con l'art. 16-ter del Decreto Legge 131/2024. In base alla nuova disposizione devono essere assoggettate ad IVA le prestazioni di servizi di distacchi di personale tra le imprese anche quando sono rese a fronte del rimborso del puro costo, erogate in adempimento di contratti stipulati o rinnovati dal 1° gennaio 2025.Le nuove disposizioni prevedono anche una clausola di salvaguardia per i comportamenti posti in essere anteriormente alla predetta data. In particolare, in assenza di accertamenti definitivi, è legittimo sia il comportamento dell'impresa che non ha addebitato l'IVA alle prestazioni di distacco di personale in forza della previgente normativa nazionale sia la condotta dell'impresa che ha addebitato l'IVA su dette prestazioni in conformità all'orientamento espresso dalla Corte di Giustizia UE. Nel caso in esame, chiarisce l'Agenzia Entrate, è riscontrabile un nesso diretto, nell'accezione fatta propria dalla Corte di Giustizia UE, tra la prestazione della richiedente, avente ad oggetto il distacco del proprio personale presso altro ente, e la controprestazione di quest'ultimo, in quanto gli importi versati alla società e il distacco di personale si condizionano reciprocamente. Dunque, gli importi erogati dall'ente alla società, a titolo di rimborso del costo complessivo sostenuto da quest'ultima per ogni singolo lavoratore distaccato (comprensivo di tutti gli oneri contributivi e assicurativi) dovranno essere assoggettati ad imposta.   • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
