Chiarimenti in materia di blocco dei pagamenti dalle Pubbliche Amministrazioni


Il Ministero dell’Economia e delle Finanze, con la Ragioneria generale dello Stato, tramite la Circolare n. 13 del 21 marzo 2018, ha fornito chiarimenti in merito a quanto previsto dall’art. 48 bis  del DPR 602/73. Secondo tale articolo, le Pubbliche Amministrazioni, al momento dell’erogazione di un importo pari o superiore a 5.000 euro, devono verificare la presenza di ruoli non onerati presso l’Agenzia Entrate - Riscossione. Quest’ultima dovrà fornire una risposta entro 5 giorni lavorativi ed in caso di silenzio la Pubblica Amministrazione potrà procedere al pagamento. A partire dal 1° marzo 2018, per effetto della Legge di Bilancio 2018, il limite oltre cui scatta tale adempimento è stato stabilito, appunto, a 5.000 euro; in precedenza era 10.000. La verifica sopra descritta deve essere operata da tutte le Pubbliche Amministrazioni, compresi gli Enti Pubblici, come i consorzi di sviluppo industriale o le gestioni commissariali. Diversamente le fondazioni e le associazioni senza personalità giuridica di diritto pubblico non devono effettuare la verifica. Si ricorda che per le operazioni effettuate nei confronti delle Pubbliche Amministrazioni, il cedente deve emettere fattura ex art. 17 ter  DPR 633/72, ovvero in split payment: l’IVA viene versata direttamente dalla Pubblica Amministrazione. In tal caso la verifica dei 5.000 euro deve essere effettuata al netto dell’Imposta sul Valore Aggiunto. La verifica deve essere effettuata anche se deriva da una sentenza, mentre in caso di mandata deve essere effettuata in capo al mandante.

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
