MODEM E ROUTER LIBERI - AGCOM HA AVVIATO UNA CONSULTAZIONE PUBBLICA


È giusto che i provider internet impongano il loro modem ai clienti? Con questa domanda in mente l'Autorità per le Garanzie nelle Comunicazioni (AGCOM), con la delibera 35/18/CONS del 30 gennaio 2018, ha avviato - a decorrere dal 6 febbraio 2018 - una consultazione pubblica invitando tutte le parti interessate a inviare commenti, osservazioni e proposte con riferimento al diritto degli utenti finali di utilizzare modem router di loro scelta e al divieto dei fornitori di servizi di accesso a Internet di stipulare accordi con gli utenti finali e/o adottare pratiche commerciali che limitino l'esercizio di tale diritto. L'idea è di regolamentare il mercato dei modem e dei router, in modo da porre i consumatori nelle condizioni di poter scegliere "liberamente e consapevolmente" secondo i principi della neutralità della rete. La consultazione pubblica è volta ad acquisire commenti, elementi di informazione e documentazione concernenti le modalità di applicazione del Regolamento (UE) 2015/2120, articolo 3, commi 1 e 2. Tali commi, con specifico riferimento al servizio di accesso a Internet, si riferiscono, rispettivamente, al diritto degli utenti finali di utilizzare apparecchiature terminali di loro scelta e al divieto dei fornitori di servizi di accesso a Internet di stipulare accordi con gli utenti finali e/o adottare pratiche commerciali che limitino l'esercizio di tale diritto. Entro il termine ultimo di 30 giorni dalla data di pubblicazione della delibera, consumatori, operatori di telecomunicazioni, installatori, produttori di dispositivi per il networking, distributori e altri soggetti interessati hanno la facoltà di trasmettere ad AGCOM le loro osservazioni tramite PEC all'indirizzo agcom@cert.agcom.it E' accettato l'invio anche all'indirizzo di posta "normale" dsd.regolamentazione@agcom.it indicando come oggetto la denominazione del rispondente seguita dalla dicitura "Consultazione pubblica concernente possibili misure per la libera scelta di apparecchiature terminali". Statement on the GDPR (General Data Protection Regulation)

The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
