SOSPENSIONE COMUNICAZIONI DEL FISCO AD AGOSTO E DICEMBRE. NUOVI CHIARIMENTI DELLE ENTRATE


Con la Circolare n. 9/E del 2 maggio l'Agenzia delle Entrate fornisce istruzioni sulle misure di semplificazione e razionalizzazione previste dal Dlgs n. 1/2024 (c.d. Decreto Adempimenti) in attuazione della Delega fiscale. Nel documento l’esame delle nuove misure è suddiviso in quattro paragrafi, dedicati rispettivamente alle semplificazioni relative al pagamento dei tributi, alla razionalizzazione delle comunicazioni obbligatorie, al potenziamento dei servizi digitali e ai periodi di sospensione per le comunicazioni e gli inviti ai contribuenti.  Relativamente a quest'ultima novità si prevede che, salvo casi di indifferibilità e urgenza, l'Agenzia delle Entrate non potrà inviare comunicazioni e inviti al contribuente nei periodi dell’anno che vanno dal 1° agosto al 31 agosto e dal 1° dicembre al 31 dicembre. Rientrano tra gli atti interessati dalla novità: le comunicazioni concernenti gli esiti dei controlli automatizzati e dei controlli formali delle dichiarazioni; gli esiti della liquidazione delle imposte dovute sui redditi assoggettati a tassazione separata; le lettere di invito per l’adempimento spontaneo.  La previsione, chiariscono le Entrrate, non fa venir meno la sospensione, già prevista ex lege nel periodo 1° agosto-4 settembre, in relazione al pagamento delle somme dovute in esito alla stessa tipologia di atti, nonché in relazione alla trasmissione di documenti e informazioni richiesti ai contribuenti dall’Agenzia delle entrate o da altri enti impositori. L'Agenzia chiarisce inoltre che possono costituire ipotesi di indifferibilità e urgenza, tali da richiedere una deroga al suddetto regime di sospensione: le situazioni in cui sussiste pericolo per la riscossione, intendendosi come tali anche i casi in cui la mancata spedizione della comunicazione o notifica dell’atto pregiudichi il rispetto dei termini di prescrizione e decadenza previsti in materia di riscossione, con conseguente rischio di compromettere il recupero delle somme dovute; l’invio di comunicazioni o atti che prevedono l’inoltro di una notizia di reato ai sensi dell’articolo 331 del codice di procedura penale; l’invio di comunicazioni o atti destinati a soggetti sottoposti a procedure concorsuali, ai fini della tempestiva insinuazione nel passivo.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
