ACCERTAMENTI BANCARI: IL GIUDICE DEVE VERIFICARE L'EFFICACIA DELLE PROVE OFFERTE DAL CONTRIBUENTE


In tema di accertamenti bancari la Corte di Cassazione, Sez. V Civile, nell'Ordinanza n. 22047 del 24 luglio 2023 ha chiarito che "gli artt. 32 del d.P.R. n. 600 del 1973 e 51 del d.P.R. n. 633 del 1972 prevedono una presunzione legale in favore dell'erario che, in quanto tale, non necessita dei requisiti di gravità, precisione e concordanza richiesti dall'art. 2729 c.c. per le presunzioni semplici, e che può essere superata dal contribuente attraverso una prova analitica, con specifica indicazione della riferibilità di ogni versamento bancario, idonea a dimostrare che gli elementi desumibili dalle movimentazioni bancarie non attengono ad operazioni imponibili, cui consegue l'obbligo del giudice di merito di verificare con rigore l'efficacia dimostrativa delle prove offerte dal contribuente per ciascuna operazione e di dar conto espressamente in sentenza delle relative risultanze". La prova, dunque, si legge ancora nell'Ordinanza, deve essere "idonea a dimostrare che gli elementi desumibili dalle movimentazioni bancarie non sono riferibili ad operazioni imponibili, con indicazione specifica della riferibilità di ogni versamento bancario, in modo da dimostrare come ciascuna delle singole operazioni effettuate sia estranea a fatti imponibili e, a tale dimensionamento dell'onere della prova gravante sul contribuente, corrisponde l'obbligo del giudice di merito, da un lato, di operare una verifica rigorosa dell'efficacia dimostrativa delle prove fornite dal contribuente a giustificazione di ogni singola movimentazione accertata, e, dall'altro, di dare espressamente conto in sentenza delle risultanze di quella verifica".   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
