DL OMNIBUS: IMPOSTA STRAORDINARIA A CARICO DELLE BANCHE CALCOLATA SULL?"INCREMENTO DEI MARGINI DI INTERESSE


L'Art. 26 del Dl n. 104/2023 (cosiddetto "Decreto Omnibus"), pubblicato sulla Gazzetta Ufficiale n. 186 del 10 agosto scorso, prevede l'istituzione per l'anno 2023, in dipendenza dell'andamento dei tassi di interesse e del costo del credito, di un'imposta straordinaria a carico delle banche calcolata sull’incremento dei margini di interesse.L'imposta, in particolare, è determinata applicando un'aliquota pari al 40% sul maggior valore tra: l'ammontare del margine di interesse di cui alla voce 30 del conto economico redatto secondo gli schemi approvati dalla Banca d'Italia relativo all'esercizio antecedente a quello in corso al 1° gennaio 2023 che eccede per almeno il 5% il medesimo margine nell'esercizio antecedente a quello in corso al 1° gennaio 2022; l'ammontare del margine di interesse di cui alla voce 30 del predetto conto economico relativo all'esercizio antecedente a quello in corso al 1° gennaio 2024 che eccede per almeno il 10% il medesimo margine nell'esercizio antecedente a quello in corso al 1° gennaio 2022.  L'ammontare dell'imposta straordinaria, in ogni caso, non può essere superiore a una quota pari allo 0,1% del totale dell'attivo relativo all'esercizio antecedente a quello in corso al 1° gennaio 2023. L'imposta straordinaria, che è versata entro il sesto mese successivo a quello di chiusura dell'esercizio antecedente a quello in corso al 1° gennaio 2024, non è deducibile ai fini delle imposte sui redditi e dell'imposta regionale sulle attività produttive. Ai fini dell'accertamento, delle sanzioni, della riscossione dell'imposta e del contenzioso, si applicano le disposizioni in materia di imposte sui redditi.   • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
