WHISTLEBLOWING: I NUOVI ADEMPIMENTI PER I DATORI DI LAVORO


I datori di lavoro pubblici e privati dovranno presto effettuare una serie di adempimenti per adeguarsi alle nuove norme in materia di Whistleblowing, previste dal D.Lgs. n. 24/2023. Whistleblowing è un termine di chiara origine anglosassone utilizzato per individuare il soggetto che, pur restando nell’anonimato, segnala al datore di lavoro pubblico o privato la possibile commissione di violazioni penali, civili od amministrative. Le novità previste dal D.L.vo n. 24/2023 entreranno in vigore: a) entro il prossimo 15 luglio 2023 per i datori di lavoro che hanno occupato, mediamente, negli ultimi dodici mesi, più di 249 dipendenti; b) entro il 17 dicembre 2023 per i datori di lavoro che hanno occupato, mediamente, negli ultimi dodici mesi, almeno 50 lavoratori dipendenti, così come quelli che, pur rimanendo sotto la soglia delle 50 unità, hanno come genere di attività i servizi ed i prodotti finanziari, la prevenzione del riciclaggio e le misure atte a bloccare il finanziamento del terrorismo, la sicurezza dei trasporti e la tutela dell’ambiente, nonché quelli che adottano i modelli organizzativi ex D.L.vo n. 231/2001.   Il D.Lgs. n. 24/2023, attuativo della direttiva europea 2019/1937, raccoglie in un unico testo normativo l’intera disciplina dei canali di segnalazione e delle tutele riconosciute ai segnalanti, sia del settore pubblico che privato.Tutte le novità introdotte sono illustrate in un report elaborato dall’Autorità Nazionale Anticorruzione. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
