TUTELA E LA TRACCIABILITà DEI PRODOTTI: COSA PREVEDE IL DDL 'MADE IN ITALY'


Il Ddl Made in Italy recentemente approvato dal Governo prevede misure, che intervengono anche in materia penale, a tutela dei prodotti italiani, per assicurare la loro riconoscibilità e provenienza. In tema di lotta alla contraffazione: si aumentano le sanzioni amministrative pecuniarie per gli illeciti di acquisto e introduzione di prodotti contraffatti; si modificano il Codice penale e il Codice di procedura penale, per punire anche coloro che detengono per la vendita prodotti contraffatti e per velocizzare e semplificare le operazioni di distruzione della merce contraffatta sequestrata; si estendono le disposizioni in materia di operazioni sotto copertura ai reati di contraffazione; si valorizza la collaborazione prestata dallo straniero nel corso delle indagini per l’identificazione dei produttori e dei distributori delle merci contraffatte; si introducono introdotte misure per la formazione specialistica dei magistrati per il contrasto ai reati di contraffazione. Relativamente, invece, alla tracciabilità e riconoscibilità dei prodotti Made in Italy: si adotta un contrassegno ufficiale di attestazione dell’origine italiana delle merci, apponibile, su base volontaria, dalle imprese sui beni prodotti sul territorio nazionale; si effettua una ricognizione dei prodotti industriali e artigianali tipici, radicati in una specifica zona geografica, e si adottano disciplinari di produzione con la costituzione di associazioni di produttori per la valorizzazione dei prodotti oggetto dei disciplinari; si prevede l’uso delle nuove tecnologie per la tracciabilità dei prodotti tramite l’istituzione di un catalogo nazionale con i requisiti fissati dall’European Blockchain Service Infrastructure (EBSI); si riorganizzano le competenze degli uffici giudiziari per garantire la specializzazione dei magistrati in materia di lotta alla contraffazione e la loro formazione in materia. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
