MALATTIA PROFESSIONALE E SOSPENSIONE ADEMPIMENTI TRIBUTARI


Con il Pronto Ordini n. 10/2023 il CNDCEC ricorda che, allo stato attuale, non esiste un procedimento concordato con l’Agenzia delle Entrate per ottenere la sospensione della decorrenza dei termini degli adempimenti tributari a carico del libero professionista in caso di malattia o di infortunio. Dunque, in presenza delle fattispecie e dei presupposti previsti dalla legge, è consigliabile preparare una dichiarazione sostitutiva dell'atto di notorietà in cui si attesta la sussistenza della grave malattia (dove per «grave malattia» s'intende uno stato patologico di salute, non derivante da infortunio, la cui gravità sia tale da determinare il temporaneo mancato svolgimento dell'attività professionale, a causa della necessità di provvedere ad immediate cure ospedaliere o domiciliari, ovvero a indagini e analisi finalizzate alla salvaguardia dello stato di salute) e degli altri presupposti, oltre alla documentazione richiesta dal comma 935 dell'art. 1 della L. 234/2021. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
