ESECUZIONI IMMOBILIARI: FORMULARIO CNDCEC-FNC PER CUSTODI GIUDIZIARI E DELEGATI ALLE VENDITE


Il Consiglio e la Fondazione Nazionale dei Commercialisti hanno pubblicato un Formulario rivolto ai professionisti che operano nel settore delle esecuzioni immobiliari con la funzione di custode giudiziario e delegato alle vendite. Il documento, che raccoglie modelli pronti, sintetici e conformi al rito esecutivo, aggiornati alla riforma Cartabia e al correttivo del d.lgs. n. 164/2024, nasce con l'obiettivo di agevolare la reperibilità e la consultazione delle formule (per fasi del processo esecutivo e per tipologia di esecuzione), offrendo un supporto tecnico-professionale coerente con le prassi dei tribunali e con il nuovo quadro processuale.Il Formulario si propone come un vero e proprio strumento operativo aggiornato, per orientare il professionista nelle diverse fasi dell?"esecuzione, mantenendo al contempo la coerenza con le esigenze del processo telematico e con l'evoluzione post Cartabia.E' strutturato in cinque sezioni (Custodia, La Delega delle Operazioni di Vendita, Fase della vendita, Il Decreto di Trasferimento, La Fase Distributiva), che comprendono 34 formule relative alle differenti fasi del processo esecutivo. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
