Entro il 30 novembre la comunicazione al MIMIT per gli investimenti '4.0', R&S e Formazione del 2022


Il prossimo 30 novembre 2023 scadrà il termine per l’invio al Ministero delle Imprese e del made in Italy (oggi MIMIT, ex MISE) la comunicazione dei dati e delle informazioni rilevanti riguardanti il credito d’imposta per gli investimenti “4.0”. Il modello di comunicazione, firmato digitalmente dal legale rappresentante dell’impresa, deve essere trasmesso tramite PEC all’indirizzo benistrumentali4.0@pec.mise.gov.it .In caso di problemi tecnici, il modello può essere inviato direttamente alla PEC della Direzione: dgpiipmi.dg@pec.mise.gov.it . Ricordiamo che il comma 5 dell’art. 1 del DM 6 ottobre 2021 prevede che “l’invio del modello di comunicazione approvato con il presente decreto non costituisce presupposto per l’applicazione del credito d’imposta e i dati e le informazioni in esso indicati sono acquisiti dal Ministero dello sviluppo economico al solo fine di valutare l’andamento, la diffusione e l’efficacia delle misure agevolative. L’eventuale mancato invio del modello non determina comunque effetti in sede di controllo da parte dell’Amministrazione finanziaria della corretta applicazione della disciplina agevolativa”. Analoghe comunicazioni sono previste, sempre entro il 30 novembre, anche per il credito ricerca, sviluppo e innovazione (art. 1 commi 200 ss. della L. 160/2019) e per il credito formazione 4.0 (art. 1 commi da 46 a 56 della L. 205/2017). Anche per tali agevolazioni la comunicazione non costituisce presupposto per la disciplina agevolativa. Per il credito d’imposta per gli investimenti in attività di ricerca e sviluppo, attività di innovazione tecnologica e attività di design e ideazione estetica, il modello di comunicazione, firmato digitalmente dal legale rappresentante dell’impresa, va trasmesso tramite PEC all’indirizzo cirsid@pec.mise.gov.it o dgpiipmi.dg@pec.mise.gov.it. Per il credito d’imposta per le spese di formazione 4.0, il modello di comunicazione, firmato digitalmente dal legale rappresentante dell’impresa, va trasmesso tramite PEC all’indirizzo formazione4.0@pec.mise.gov.it o dgpiipmi.dg@pec.mise.gov.it .

The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
