E-FATTURE: DAL 20 MARZO ACCESSO AL SERVIZIO DI CONTULTAZIONE SENZA ESPRESSA RICHIESTA


Dal prossimo 20 marzo operatori economici, intermediari delegati e consumatori finali potranno accedere al servizio di consultazione e acquisizione delle proprie fatture elettroniche senza necessità di preventiva adesione.  L’articolo 4-quinquies, comma 4, del DL n. 145/2023 ha infatti rivisto la disposizione secondo cui le e-fatture dovevano essere messe a disposizione dei consumatori finali su richiesta di quest’ultimi, andando quindi ad eliminare la necessità di una espressa richiesta di consultazione da parte del contribuente consumatore finale. Venuto meno questo vincolo, e stante comunque la possibilità per l’Agenzia delle entrate di memorizzare i file delle fatture elettroniche fino al 31 dicembre dell'ottavo anno successivo a quello di presentazione della dichiarazione di riferimento ovvero fino alla definizione di eventuali giudizi, con Provvedimento dell'8 marzo viene estesa la possibilità per tutti i contribuenti, siano essi operatori economici, persone fisiche o soggetti, diversi da persone fisiche, non titolari di partita IVA, di avvalersi del servizio di consultazione e acquisizione delle fatture elettroniche e dei loro duplicati informatici più agevolmente, senza la necessità di sottoscrivere un accordo di servizio. Viene inoltre previsto: che le fatture elettroniche siano disponibili in consultazione fino al 31 dicembre del secondo anno successivo a quello di ricezione da parte del Sistema di Interscambio. che i "dati fattura", come già avviene per gli operatori economici, siano messi a disposizione in consultazione fino al 31 dicembre dell’ottavo anno successivo a quello di presentazione della dichiarazione di riferimento.  Con lo stesso Provvedimento l'Agenzia delle Entrate estente il servizio di registrazione dell’indirizzo telematico di consegna delle fatture elettroniche, già a disposizione dei soggetti IVA, anche gli enti non commerciali. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
