DANNI SUBITI PER CADUTA IN CANTIERE STRADALE: CHI è RESPONSABILE?


"In tema di danni determinati dall'esistenza di un cantiere stradale, qualora l'area di cantiere risulti completamente enucleata, delimitata ed affidata all'esclusiva custodia dell'appaltatore, con conseguente assoluto divieto su di essa del traffico veicolare e pedonale, dei danni subiti all'interno di questa area risponde esclusivamente l'appaltatore, che ne è l'unico custode. Allorquando, invece, l'area su cui vengono eseguiti i lavori e insiste il cantiere risulti ancora adibita al traffico e, quindi, utilizzata a fini di circolazione, denotando questa situazione la conservazione della custodia da parte dell'ente titolare della strada, sia pure insieme all'appaltatore, consegue che la responsabilita? ai sensi dell'art. 2051 cod. civ. sussiste sia a carico dell'appaltatore che dell'ente, salva l'eventuale azione di regresso di quest'ultimo nei confronti del primo a norma dei comuni principi sulla responsabilità solidale". Questo il principio affermato dalla Corte di Cassazione Civile, Sez. 6, con l'ordinanza n. 7096 del 12 marzo 2019. La vicenda oggetto dell'ordinanza ha riguardato un uomo che, mentre era alla guida del proprio ciclomotore, era caduto a causa di una buca non segnalata presente sulla strada comunale. Alla luce del principio sopra enunciato la Corte di Cassazione, ha rigettato il ricorso proposto dal Comune, in quanto inammissibile, e confermato quanto già deciso dalla Corte d'appello di Palermo, che aveva accolto la domanda di condanna al risarcimento dei danni proposta dall'uomo nei confronti del Comune, ritenuto responsabile, ai sensi dell'art. 2051 c.c., delle lesioni personali subite dallo stesso, che si era infortunato cadendo.
