DAL CDM L'APPROVAZIONE DEFINITIVA ALLA V DIRETTIVA ANTIRICICLAGGIO


Il Consiglio dei Ministri, nella seduta del 3 ottobre 2019, ha approvato, in esame definitivo, un decreto legislativo che introduce modifiche ed integrazioni ai decreti legislativi 25 maggio 2017, n.90 e n. 92 e dà attuazione alla direttiva 2018/843/UE (denominata V direttiva antiriciclaggio). Il testo, che tiene conto dei pareri espressi dal Garante per la protezione dei dati personali e dalle competenti Commissioni parlamentari, mira, tra l'altro, a: puntualizzare le categorie di soggetti tenuti all'osservanza degli obblighi antiriciclaggio, ricomprendendo, tra l'altro, le succursali "insediate" degli intermediari assicurativi (ossia le succursali insediate in Italia di agenti e broker aventi sede legale e amministrazione centrale in un altro Stato membro o in uno Stato terzo); individuare misure di adeguata verifica rafforzata che gli intermediari bancari o finanziari devono attuare in relazione alla clientela che opera con Paesi ad alto rischio di riciclaggio o di finanziamento del terrorismo, tra cui specifici obblighi di segnalazione periodica per le transazioni effettuate con soggetti operanti in questi Paesi; introdurre una serie di strumenti che le autorità di vigilanza possono utilizzare per mitigare il rischio connesso ai Paesi terzi, quali, per esempio, il diniego all'autorizzazione all'attività per intermediari bancari o finanziari esteri o all'apertura di succursali in Paesi ad alto rischio per gli intermediari italiani; consentire alla Direzione nazionale antimafia e antiterrorismo di disporre del Nucleo speciale di polizia valutaria; stabilire, coerentemente con il vigente divieto di conti e libretti di risparmio in forma anonima o con intestazione fittizia, il divieto di emissione e utilizzo di prodotti di moneta elettronica anonimi; apportare modifiche riguardo alle sanzioni, e alle relative procedure di irrogazione, per la violazione delle norme dei due decreti modificati. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
