CREDITO D?"IMPOSTA ZES UNICA: IMMOBILI AGEVOLABILI SOLO FINO A METà INVESTIMENTO


Con Risposta n. 183 dell'8 luglio l'Agenzia delle Entrate fornisce chiarimenti in merito all'applicazione della disciplina del credito d'imposta per investimenti nella zona economica speciale per il Mezzogiorno­-ZES Unica. L'Istante, una società che svolge la propria attività presso uno stabilimento in virtù di contratto di locazione commerciale, vorrebbe accedere al Credito di imposta ZES Unica, in quanto intende estendere la capacità dello stabilimento esistente, acquistando nuovi macchinari, impianti e attrezzature, nonché procedere all'acquisto dell'immobile strumentale, costituito dalla parte attualmente locata e da una nuova porzione costituita da immobile e piazzale.L'acquisto dell'immobile avrà un costo pari a circa 600mila euro, mentre il costo degli ulteriori beni strumentali (macchinari e attrezzature varie) ammonta a 270mila euro.La società chiede chiarimenti in merito all'interpretazione della normativa di riferimento, che prevede che il valore dei terreni e dei fabbricati ammessi all'agevolazione non possa superare il 50% del valore complessivo dell'investimento agevolato. Sul punto l'Agenzia delle Entrate chiarisce che le spese per l'acquisto di terreni e l'acquisizione, realizzazione o l'ampliamento di immobili strumentali possono accedere al calcolo del credito d?"imposta Zes unica fino a una quota del 50% in relazione a ogni singolo progetto di investimento.  Pertanto, concludono le Entrate, l'investimento ammesso al Credito di imposta ZES Unica, nel caso prospettato nell'istanza in esame, avrà un valore complessivo pari a 540mila euro, di cui euro 270mila corrispondente al costo di macchinari e attrezzature (componente non immobiliare) e 270mila euro rappresentato dalla quota agevolabile dell'investimento nella componente immobiliare, che, come detto, non può essere superiore alla metà del valore complessivo dell'investimento agevolato.
