CREDITO D'IMPOSTA BENI STRUMENTALI: LA "DICITURA IN FATTURA" NEL CASO DEL LEASING


Il credito d’imposta investimenti in beni strumentali nuovi (INDUSTRIA 4.0) è riconosciuto anche per gli investimenti effettuati tramite contratto di leasing (locazione finanziaria). L’Amministrazione finanziaria ha chiarito con la risposta n. 439/2020 con riferimento al credito di imposta di cui alla legge n. 160/2020 che la mancata indicazione della norma agevolativa in fattura comporta la revoca del beneficio. Ha tuttavia precisato la possibilità di regolarizzare i documenti già emessi (privi del riferimento citato) entro la data in cui sono avviate attività di controllo. Poiché secondo la suddetta risposta la predetta regolarizzazione, in ipotesi di acquisizione dei beni in leasing, deve essere operata da parte dell’impresa beneficiaria, si è ritenuto che la predetta indicazione (da integrare ove mancante) debba esser riportata nelle fatture relative ai canoni di leasing emesse dalla società di leasing all’impresa che intende beneficiare del credito d’imposta. Infine, poiché il comma 195, dell’articolo 1 della legge n. 160 del 2019, dispone che “Ai fini dei successivi controlli, i soggetti che si avvalgono del credito d’imposta sono tenuti a conservare, pena la revoca del beneficio, la documentazione idonea a dimostrare l’effettivo sostenimento e la corretta determinazione dei costi agevolabili. A tal fine, le fatture e gli altri documenti relativi all’acquisizione dei beni agevolatidevono contenere l’espresso riferimento alle disposizioni dei commi da 184 a 194…” si rende opportuno riportare la dicitura anche sul contratto di leasing.

  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
