CORSI DI AGGIORNAMENTO PER PROFESSIONISTI ANTINCENDIO, RSPP E COORDINATORI PER LA SICUREZZA: CHIARIMENTI DAL MIN. DEL LAVORO


La Commissione per gli interpelli in materia di salute e sicurezza sul lavoro del Ministero del Lavoro e delle Politiche Sociali, ha fornito risposta, in data 31 gennaio 2019, all'interpello n. 1/2019, in tema di salute e sicurezza sul lavoro, con destinatario il Consiglio Nazionale degli Ingegneri. L'interpello, in particolare, ha avuto come oggetto i corsi di aggiornamento per i professionisti antincendio, per RSPP e coordinatori per la sicurezza. Alla Commissione è stato chiesto un parere in merito a quanto segue: 1. se "sia consentito organizzare un unico corso formativo valido sia quale aggiornamento per RSPP, ASPP e coordinatori per la sicurezza nei cantieri, sia quale aggiornamento per la qualifica di professionista antincendio, ex d.lgs. n. 139/2006 e DM 5 agosto 2011"; 2. se "sia possibile erogare tale corso sotto forma, da un lato, di aggiornamento per RSPP, ASPP e coordinatori per la sicurezza, e, contemporaneamente, dall'altro lato, quale convegno o seminario di aggiornamento per i professionisti antincendio". Il Ministero del Lavoro, sulla base di quanto stabilito nel punto 9 dell'Allegato A dell'Accordo in sede di Conferenza Permanente per i rapporti tra lo Stato, le Regioni e le Provincie Autonome di Trento e di Bolzano del 7 luglio 2016, ha ritenuto che: 1. ai fini dell'aggiornamento per RSPP e ASPP non sia valida la partecipazione a corsi di formazione finalizzati all'aggiornamento di qualifiche specifiche diverse, ad eccezione della partecipazione ai corsi di aggiornamento per formatori per la sicurezza sul lavoro, ai sensi del decreto interministeriale 6 marzo 2013 e a quelli per coordinatori per la sicurezza, ai sensi dell'Allegato XIV del d.lgs. n. 81/2008. Ai fini dell'aggiornamento per coordinatori per la sicurezza il punto 9 dell'Accordo specifica che non sia valida la partecipazione a corsi di formazione finalizzati a qualifiche specifiche diverse, con le uniche eccezioni di quelli relativi all'aggiornamento per RSPP e ASPP; 2. non sia possibile che il medesimo evento possa essere configurato sia come corso di aggiornamento che come convegno o seminario, sulla base di quanto previsto nel citato punto 9 dell'Allegato A dell'Accordo Stato/Regioni del 7 luglio 2016 che ne differenzia le modalità di attuazione.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
