COOPERATIVE COMPLIANCE PER PMI: COME ADERIRE AL REGIME OPZIONALE


L'articolo 7-bis del D.lgs n. 128/2015, introdotto dal D.lgs n. 221/2023, prevede che i contribuenti che non possiedono i requisiti dimensionali per aderire al regime di adempimento collaborativo, possano optare per l?"adozione di un sistema di rilevazione, misurazione, gestione e controllo del rischio fiscale, dandone apposita comunicazione all?"Agenzia delle entrate.L?"opzione ha una durata di due periodi d?"imposta e alla scadenza si rinnova automaticamente per altri due periodi, salvo revoca espressa. Con il provvedimento del 3 febbraio l?"Agenzia delle Entrate definisce le linee guida per accedere all'istituto ed approva il modello di adesione, insieme alle relative istruzioni. A chi è rivolto il regime opzionalePossono accedere all'istituto le imprese che adottano un sistema di controllo del rischio fiscale con fatturato inferiore a 500 milioni di euro per il 2026 e per il 2027, limiti previsti per l?"ammissione al regime di cooperative compliance, a condizione che il contribuente abbia adottato un comportamento coerente con quello rappresentato nell?"interpello stesso e che non abbia realizzato violazioni tributarie caratterizzate da condotte fraudolente.L?"adesione comporta diversi benefici, tra cui la non applicazione delle sanzioni amministrative e penali per le violazioni tributarie relative a rischi di natura fiscale comunicati all?"Agenzia con istanza di interpello. Come presentare la domandaPer aderire al regime opzionale le imprese interessate devono presentare la domanda utilizzando il modello approvato con i provvedimento del 3 febbraio, che deve essere firmato e inviato via Pec alla Direzione centrale Grandi contribuenti e internazionale (dc.acc.cooperative@pec.agenziaentrate.it), che è competente in via esclusiva per la ricezione delle comunicazioni di adesione. Alla domanda va allegata la documentazione prevista (art. 2, comma 3 del decreto del 9 luglio 2025), tra cui la Mappa dei rischi e dei controlli fiscali.   • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
