COMMERCIO ELETTRONICO E PIATTAFORME ON LINE - IN VIGORE IL REGOLAMENTO (UE) 2019/1150 - NUOVE REGOLE DI EQUITà E TRASPARENZA PER GLI UTENTI COMMERCIALI


Garantire scambi equi e trasparenti attraverso un ambiente web affidabile, un sistema di gestione dei reclami e mediatori per la risoluzione delle controversie. E' l'obiettivo del nuovo regolamento UE 2019/1150 del Parlamento europeo e del Consiglio del 20 giugno 2019 che promuove equità e trasparenza per gli utenti commerciali dei servizi di intermediazione online (pubblicato sulla GUUE n. L 186 del 11 luglio 2019). Le piattaforme digitali si sono da tempo create uno spazio di notevole importanza nell'ambito del commercio elettronico. Partendo da questo indubitabile assunto e dalla constatazione che in svariate occasioni gli utenti "business" di questi servizi hanno lamentato un deficit di chiarezza e trasparenza, specialmente con riferimento ai termini ed alle condizioni del servizio per l'utenza, la UE si è prefissa l'obiettivo di migliorare queste situazioni di deficit ed assicurare la possibilità di avvalersi di idonei meccanismi di ricorso in ambito comunitario. A tali esigenze risponde, IL legislatore comunitario risponde con il citato regolamento (UE) 2019/1150. Il provvedimento rafforza le tutele dell'utente "business" e delle imprese clienti, obbligando le piattaforme online ad una maggiore trasparenza nella definizione dei termini e delle condizioni di fornitura dei servizi d'intermediazione. Per "utente commerciale", secondo quanto stabilito all'art. 2, comma 1, n. 1), del Regolamento (UE) 2019/1150, si intende: "un privato che agisce nell'ambito delle proprie attività commerciali o professionali o una persona giuridica che offre beni o servizi ai consumatori tramite servizi di intermediazione online per fini legati alla sua attività commerciale, imprenditoriale, artigianale o professionale". I destinatari di questo regolamento sono: i "servizi di intermediazione on line" ed i "motori di ricerca on line". Non rilevano il luogo di stabilimento o di residenza del fornitore di tali servizi né la legge ad essi applicabile. I servizi inoltre devono essere forniti o essere proposti a utenti commerciali o a utenti titolari di siti web aziendali con luogo di stabilimento o di residenza nella UE, che si avvalgano dei predetti servizi di intermediazione "on line" o motori di ricerca "on line" per proporre i propri prodotti o servizi ai consumatori comunitari (art. 1). Nel primo gruppo di destinatari ("servizi di intermediazione on line") rientrano le piattaforme che vendono on line conto terzi, gli stores di applicazioni software, i sempre più diffusi sistemi di comparazione di prezzi o tariffe ed i social media usati per finalità professionali. Del secondo gruppo, invece, fanno parte i classici motori di ricerca sul web. Sono esclusi dal novero dei soggetti a cui si applica questo regolamento i servizi di pagamento on line, gli strumenti di pubblicità on line e gli scambi pubblicitari on line, che non sono destinati ad agevolare transazioni dirette e che non implichino una relazione contrattuale con la platea dei consumatori. Il regolamento è entrato in vigore il ventesimo giorno successivo alla pubblicazione nella Gazzetta Ufficiale dell'Unione Europea e si applicherà a partire dal 12 luglio 2020. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
