CINQUE PER MILLE DELL'IRPEF - OBBLIGHI DI RENDICONTAZIONE - CHIARIMENTI MINISTERO DEL LAVORO


A seguito di numerosi quesiti di enti e centri di servizio per il volontariato, il Ministero del Lavoro e delle Politiche sociali, con la Nota del 26 febbraio 2019, Prot. 0002106, ha chiarito la disciplina da applicare in tema di obblighi di rendicontazione e pubblicazione del contributo 5x1000. Ai sensi del D.P.C.M. 23 aprile 2010, tutti gli enti beneficiari del contributo sono obbligati a redigere il rendiconto delle somme ricevute a titolo di 5x1000 e la relazione illustrativa. Solo per gli enti che hanno percepito un contributo non inferiore a 20.000 euro grava l'ulteriore obbligo di trasmettere la documentazione all'Amministrazione finanziatrice (che ha a sua volta l'obbligo di pubblicare l'elenco dei beneficiari e i rendiconti trasmessi). Il D.Lgs. n. 111 del 3 luglio 2017, che ha riformato l'istituto del 5x1000, ha introdotto (all'art. 8) l'ulteriore obbligo per i beneficiari di pubblicare sul proprio sito (e trasmetterlo poi all'Amministrazione finanziatrice): - gli importi percepiti; - il rendiconto; - la relazione illustrativa. A Ciascuna amministrazione erogatrice spetta, inoltre, l'obbligo di pubblicare, entro 90 giorni dalla erogazione del contributo, sul proprio sito web, gli elenchi dei soggetti ai quali è stato erogato il contributo, con l'indicazione del relativo importo, nonchè il link al rendiconto pubblicato sul sito web del beneficiario provvedendovi entro 30 giorni dall'acquisizione degli elementi informativi da parte dei beneficiari (art. 8, comma 4). L'art. 4, D.Lgs. n. 111/2017 devolve la definizione delle modalità e dei termini per il riparto del 5x1000, nonché le modalità per formazione, aggiornamento e pubblicazione dell'elenco degli enti iscritti, ad un D.P.C.M. che, a tutt'oggi, non risulta ancora emanato. Pertanto, in assenza del D.P.C.M. attuativo del D.Lgs. n. 111/2017, gli obblighi di rendicontazione del 5x1000 continuano ad essere disciplinati dagli artt. 12 e 12-bis, D.P.C.M. 23 aprile 2010, come modificato dal D.P.C.M. 7 luglio 2016. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
