CAPORALATO: DALL'INL LE LINEE GUIDA PER IL PERSONALE ISPETTIVO


A distanza di anni dall'entrata in vigore del reato di caporalato (art. 603-bis del c.p.) e dalla sua ultima modifica intervenuta nel 2016, l'Ispettorato Nazionale del Lavoro (INL), con la circolare n. 5 del 28 febbraio 2019, ha fornito le linee guida che il personale ispettivo dovrà seguire nello svolgimento dell'attività di vigilanza finalizzata a acquisire gli elementi di prova per la configurazione dell'intermediazione illecita e dello sfruttamento lavorativo. Il documento di prassi, in particolare, si sofferma sugli elementi costituitivi della fattispecie di reato di cui all'art. 603-bis c.p. e sulle modalità di svolgimento dell'attività investigativa che garantisca una corretta acquisizione dei relativi elementi di prova. Tra gli indici che caratterizzano lo sfruttamento lavorativo è possibile annoverare: la "reiterata violazione della normativa relativa all'orario di lavoro, ai periodi di riposo, al riposo settimanale, all'aspettativa obbligatoria, alle ferie"; la "sussistenza di violazioni delle norme in materia di sicurezza e igiene nei luoghi di lavoro"; e la "sottoposizione del lavoratore a condizioni di lavoro, a metodi di sorveglianza o a situazioni alloggiative degradanti".   • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
