BONUS EDILIZI: OLTRE DUE SETTIMANE IN PIù PER L'INVIO DEI DATI SU INTERVENTI CONDOMINIALI


Slitta al 4 aprile, dal precedente 16 marzo, il termine per l’invio al Fisco, da parte degli amministratori di condominio, dei dati relativi agli interventi di risparmio energetico e ristrutturazione effettuati nel 2023 sulle parti comuni condominiali, destinati a confluire nella precompilata 2024. La proroga non ha conseguenze sul calendario della campagna dichiarativa 2024.Il nuovo termine è stato disposto dall'Agenzia delle Entrate con Provvedimento del 21 febbraio, con il quale viene previsto anche l’esonero dall’invio della comunicazione dei dati nel caso in cui, con riferimento alle spese sostenute nell’anno precedente, per tutti gli interventi effettuati sulle parti comuni tutti i condòmini abbiano optato, al posto dell’utilizzo diretto della detrazione, per la cessione del credito o per lo sconto sul corrispettivo dovuto.  Con il Provvedimento, in particolare, vengono aggiornate le specifiche tecniche approvate con il provvedimento del Direttore dell’Agenzia delle entrate n. 470370 del 20 dicembre 2022, per allinearle alle novità intervenute rispetto alla disciplina che regola gli incentivi edilizi e di risparmio energetico previsti dagli articoli 119 e 119-ter del decreto “Rilancio” (Dl n. 34/2020), e dal decreto “Aiuti-quater” (Dl n. 176/2022), come modificato dalla legge di bilancio 2023 (legge n. 197/2022). Più in dettaglio, con riferimento agli interventi per cui si può usufruire del “Superbonus”, è stato inserito un ulteriore codice per la comunicazione dei dati relativi alle spese sostenute, in quanto il contribuente dal 2023 può usufruire di una detrazione del 90% e, in via residuale al verificarsi di particolari condizioni, può continuare a usufruire della detrazione pari al 110%. Rimosso, invece, ogni riferimento al “bonus facciate”, in quanto la detrazione non è stata prorogata. Le specifiche tecniche sono state aggiornate anche per recepire la proroga al 2025 del termine per la fruizione dell’agevolazione relativa al superamento ed eliminazione delle barriere architettoniche (art. 119-ter del DL n. 34/2020).
