Attenzione alla scadenza delle start up innovative


Le startup innovative possono godere dei benefici previsti entro i 5 anni dalla loro costituzione; trascorso tale periodo di tempo hanno la possibilità di trasformarsi in PMI innovative, senza perdere i benefici disponibili. In caso contrario Ciò premesso, il Decreto Legge 19 Maggio 2020 n. 34 (c.d. Decreto Rilancio), art. 38, comma 5 ha previsto che: “Il termine di permanenza nella sezione speciale del registro delle imprese delle start-up innovative di cui all’articolo 25 del decreto-legge n. 179 del 2012, è prorogato di 12 mesi. Eventuali termini previsti a pena di decadenza dall’accesso a incentivi pubblici e per la revoca del medesimi sono prorogati di 12 mesi. Ai fini del presente comma, la proroga della permanenza nella sezione speciale del registro delle imprese non rileva ai fini della fruizione delle agevolazioni fiscali e contributive previste dalla legislazione vigente”. Successivamente il Ministero dello Sviluppo Economico – MISE, con circolare n. 3724/C del 19 giugno 2020 Prot. n. 147301 diretta a tutte le Camere di Commercio ha precisato che la “previsione è stata resa necessaria per l’impatto negativo dell’epidemia per il 2020 su tutto il settore delle startup”, e quindi la proroga di 12 mesi è applicabile solo alle imprese regolarmente iscritte alla sezione speciale del registro delle Imprese alla data del 19 maggio 2020. Nel corso dell’esercizio 2023 scadranno quindi i termini per tutte le startup innovative costituite nel 2017. Entro 60 giorni dalla perdita dei requisiti, la startup deve richiedere al Registro Imprese la cancellazione dalla sezione speciale. Si manterrà la sola iscrizione alla sezione ordinaria.In caso di mancato deposito della richiesta di cancellazione o di trasferimento nella sezione “PMI innovative”, l’Ufficio Registro delle Imprese avvierà il procedimento di cancellazione d’ufficio dalla sezione speciale startup innovative.

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.

  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
