APPROVATE MISURE URGENTI IN MATERIA DI AGEVOLAZIONI FISCALI: STOP A SCONTO IN FATTURA E CESSIONE DEL CREDITO


Il Consiglio dei Ministri, nella seduta n. 75 del 26 marzo 2024 ha approvato un decreto-legge che introduce misure urgenti in materia di agevolazioni fiscali volte, in particolare, alla tutela della finanza pubblica nel settore delle agevolazioni fiscali in materia edilizia e di efficienza energetica. L’intervento, si legge sul sito del Governo, si è reso necessario anche alla luce degli ultimi dati certificati dall’ISTAT, che hanno portato alla revisione del deficit relativo all’anno 2023 arrivando alla misura del 7,2%, revisione al rialzo che segue quella già intervenuta per gli anni 2021 e 2022. Tra le principali misure previste: l’eliminazione, per gli interventi successivi all’entrata in vigore delle nuove norme, delle residue fattispecie per le quali risulta ancora vigente l’esercizio delle opzioni per il cosiddetto sconto in fattura o per la cessione del credito in luogo delle detrazioni; al fine di acquisire, alla scadenza ordinaria del termine previsto per le suddette agevolazioni (4 aprile 2024), l’ammontare del complesso delle opzioni esercitate e delle cessioni stipulate, si esclude l’applicazione dell’istituto della remissione in bonis che avrebbe consentito, con il pagamento di una minima sanzione, la comunicazione funzionale alla fruizione dei benefici fino al 15 ottobre 2024; al fine di garantire un’adeguata e tempestiva conoscenza delle grandezze economiche e finanziarie connesse alle misure agevolative oggetto del decreto, l’introduzione di misure volte ad acquisire maggiori informazioni inerenti alla realizzazione degli interventi agevolabili. È, inoltre, previsto, un corredo sanzionatorio. In particolare, l’omessa trasmissione di tali informazioni, se relativa agli interventi già avviati, determina l’applicazione di una sanzione amministrativa di euro 10.000, mentre per i nuovi interventi è prevista la decadenza dall’agevolazione fiscale; al fine di evitare la fruizione dei bonus edilizi anche da parte dei soggetti che hanno debiti nei confronti dell’erario, come già previsto nel nostro ordinamento in altri casi, si dispone la sospensione, fino a concorrenza di quanto dovuto, dell’utilizzabilità dei crediti di imposta inerenti i bonus edilizi  in presenza di iscrizioni a ruolo o carichi affidati agli agenti della riscossione relativi imposte erariali nonché ad atti emessi dall’Agenzia delle entrate per importi complessivamente superiori a euro 10.000, se scaduti i termini di pagamento e purché non siano in essere provvedimenti di sospensione o non siano in corso piani di rateazione per i quali non sia intervenuta decadenza; l’introduzione di misure volte a prevenire le frodi in materia di cessione dei crediti ACE, riducendo a una la possibilità di cessione ed estendendo la responsabilità solidale del cessionario alle ipotesi di concorso nella violazione, nonché ampliando i controlli preventivi in materia di operazioni sospette.
