Fatturazione elettronica, cosa deve sapere il consumatore


Dal 1/1/2019 è obbligatorio per tutti utilizzare la fattura elettronica, una fattura in formato digitale XML che va inviata al sistema di interscambio dell'Agenzia delle entrate (SdI) che provvede a sua volta ad inoltrarla al destinatario. Il nuovo sistema riguarda i soggetti obbligati all'emissione della fattura e, in gran parte, i rapporti commerciali tra partite IVA (1). Ma il consumatore, ovvero "l'ultimo anello della catena" su cui grava l'IVA, cosa deve sapere e fare al riguardo? In sostanza non cambia molto rispetto a prima, se non che avrà l'opportunità di accedere alle proprie fatture attraverso un'area a lui riservata sul sito dell'Agenzia delle entrate. Opportunità e non obbligo, perché chi emette fattura ad un consumatore, obbligato o dietro richiesta, deve comunque consegnargliene copia in formato analogico (in carta) o digitale (via mail, per esempio), copia che per il consumatore è perfettamente valida e del tutto sufficiente. Vediamo i dettagli. Come regola generale la fattura va sempre emessa da chi vende beni o servizi, con eccezione del commercio al minuto in luoghi aperti al pubblico (acquisti nei negozi) e dell'e-commerce (acquisti online) (2). In questi casi non esiste obbligo di fatturazione a meno che la fattura non venga richiesta dal cliente/consumatore. Stessa cosa per gli alberghi, i ristoranti e bar, il trasporto di persone, etc. Per quanto riguarda i consumatori, che la fattura sia obbligatoria o richiesta, dal 2019 è emessa elettronicamente sotto il formato denominato "B2C -Business to Consumer-". Come tutte le fatture elettroniche la B2C passa dal sistema di interscambio (SdI) che la mette a disposizione del destinatario/consumatore -identificato tramite il codice fiscale presente nel documento- tramite pubblicazione su un'area a questi riservata del sito web dell'Agenzia delle entrate (3). Il fornitore di beni o servizi deve comunque consegnare o spedire copia della fattura, in formato cartaceo o digitale, al cliente/consumatore, salvo che questi vi rinunci. Il consumatore può a tal fine fornire il proprio indirizzo Pec. L'area riservata sarà disponibile sul sito dell'Agenzia delle entrate a decorrere dal 3 Maggio 2019. Per i consumatori non vi saranno modalità transitorie di accesso, previste invece per i soggetti IVA, quindi le fatture saranno per il momento ricevute in copia direttamente da chi le emette. Al riguardo il vicedirettore dell'Agenzia delle entrate ha recentemente dichiarato che l'area riservata per le persone fisiche sarà realizzata all'interno del portale per la dichiarazione precompilata (4) e sarà accessibile previa espressa adesione. Si evidenzia, come già detto, che i consumatori NON saranno obbligati a registrarsi presso il sito dell'Agenzia delle entrate e quindi ad accedere alla propria area riservata, ma che questo sistema consentirà loro di visionare online le fatture a loro destinate in modo senz'altro agevole, per qualsiasi utilizzo.
