ACCERTAMENTO IMPOSTA SUI REDDITI: VALIDE LE VERIFICHE SUL CONTO COINTESTATO


In tema di accertamento dell'imposta sui redditi, le verifiche fiscali finalizzate a provare, per presunzioni, la condotta evasiva possono anche indirizzarsi sui conti bancari intestati al coniuge o al familiare del contribuente, potendo desumersi la riferibilità a quest'ultimo da elementi sintomatici, quali: il rapporto di stretta familiarità, l'ingiustificata capacità reddituale dei prossimi congiunti nel periodo di imposta considerato, l'infedeltà delle dichiarazioni e l'esercizio di attività da parte del contribuente compatibile con la produzione della maggiore redditività riferita a dette persone. Il principio è stato richiamato dalla Corte di Cassazione Civile, con la Sentenza n. 29160 del 6 ottobre 2022. Nel caso di specie, risultava pacifico che i conti oggetto di accertamento fossero cointestati al contribuente ed ai familiari oppure fossero conti sui quali il contribuente era autorizzato ad operare.Pertanto, sarebbe stato suo onere dimostrare che le movimentazioni contestate non erano ricollegabili ad operazioni imponibili attinenti all’attività di impresa.   • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
