L?"AMMINISTRATORE DI FATTO NON RISPONDE DELLE SANZIONI TRIBUTARIE IRROGATE ALLA SOCIETà DI CAPITALI


Sul portale della Giustizia Tributaria è stata pubblicata la rassegna delle sentenze del 15 novembre 2022. Tra queste, segnaliamo la Sentenza della CTR per la Campania n. 6855/13 del 18 ottobre 2022, dove viene richiamato il principio secondo cui l?"avviso di accertamento relativo ad imposte, interessi e sanzioni dovute da una società di capitali va notificato all?"amministratore e legale rappresentante della stessa e non all?"?"amministratore di fatto.In base a tale principio i giudici della Corte di Napoli di II grado hanno confermato la sentenza di prime cure a favore della ricorrente (amministratrice di fatto), poiché ricorrono i presupposti dell?"art. 7 D. L. n. 269/2003, secondo cui nel caso di rapporti fiscali facenti capo a persone giuridiche le sanzioni possono essere irrogate nei soli confronti dell?"ente.
