PROFESSIONISTI: APPROVATO EMENDAMENTO AL DL SOSTEGNI CHE RICONOSCE LA SOSPENSIONE ADEMPIMENTI IN CASO DI COVID


E' stato approvato l’emendamento al DL "Sostegni" che riconosce ai professionisti la sospensione di 30 giorni, in luogo dei 45 giorni indicati nella stesura originaria, dei termini delle scadenze in caso malattia da Covid-19.  "Siamo rammaricati per questa riduzione, dettata da supposti limiti di copertura, e accettiamo il compromesso", ha dichiarato il presidente dell'Associazione Nazionale Commercialisti (ANC), Marco Cuchel, "tuttavia non possiamo che gioire per una decisione che non esito a definire di portata storica, in quanto introduce anche per noi professionisti un principio sacrosanto e costituzionalmente sancito per tutti gli altri cittadini: quello del diritto alla tutela della salute. Di questo ANC, pioniera della battaglia principale di cui questo emendamento è figlio (il riconoscimento della malattia del professionista), non può che ringraziare quei parlamentari che hanno capito e si sono battuti con noi in maniera del tutto trasversale rispetto agli schieramenti. In primis, il Sen. Andrea De Bertoldi, poi la consulta dei parlamentari commercialisti, ed anche coloro che, pur non provenendo dal mondo delle libere professioni, hanno mostrato particolare sensibilità a questo tema e si sono spesi affinché l’emendamento passasse. Anche nel Governo alcuni esponenti sono meritoriamente tornati sui loro passi, dando ascolto ai nostri appelli, quando oramai sembrava che la linea fosse di chiusura". Secondo l'ANC il principio cardine su cui l’emendamento poggia, deve ora essere preso in considerazione anche per l’approvazione del ddl 1474 relativo rinvio delle scadenze in caso di malattia grave o infortunio, attualmente fermo in commissione Giustizia del Senato, anche per ragioni di copertura basate su una relazione tecnica ministeriale assolutamente confutabile nei numeri che contiene e concettualmente inaccettabile, in quanto lega la possibilità di curarsi ad un problema di gettito erariale. "A nessun lavoratore, che non è nelle condizioni di farlo, viene imposto presentarsi presso il posto di lavoro", ha dichiarato ancora Cuchel. "Non sarebbe giusto, né sicuro, né funzionale; così anche il professionista ammalato gravemente o infortunato (perché di questo parla il ddl 1474, non di un mal di testa) deve avere la possibilità di rimandare la scadenza del cliente a quando sarà adeguatamente in forze.
