Entro il 15 novembre 2020 rivalutazione di terreni e partecipazioni: opportunità da valutare al più presto


La legge di conversione (legge n. 77/2020 del 18 luglio 2020) del decreto Rilancio (D.L. n. 34/2020) ha prorogato al 15 novembre 2020 il termine per la rivalutazione di partecipazioni societarie e terreni posseduti al 1° luglio 2020. I tempi iniziano a farsi stretti perché entro quella data, per beneficiare della rivalutazione, si dovrà: versare l'imposta sostitutiva (in unica soluzione o la prima di tre rate annuali di pari importo); redigere e asseverare la perizia di stima (da parte di un professionista abilitato). Possono aderire alla rivalutazione persone fisiche non esercenti attività d'impresa; società semplici, società e associazioni ad esse equiparate ai sensi dell'art. 5 TUIR; enti non commerciali per quel che attiene alle attività non inerenti all'attività d'impresa; soggetti non residenti, privi di stabile organizzazione in Italia, che possiedano terreni (agricoli ed edificabili) o partecipazioni (sia qualificate che non qualificate), non in regime di impresa, alla data del 1 luglio 2020. L'imposta sostitutiva è pari all'11% del valore complessivo del terreno o della partecipazione oggetto di rivalutazione. L'imposta in caso di alienazione viene invece applicata solo all'eventuale plusvalenza, determinata come differente tra il corrispettivo percepito ed il valore di carico fiscale. Possono essere rivalutati anche terreni o partecipazioni cedute successivamente al 1° luglio 2020. L'Agenzia Entrate, nella circolare 47/2011, ha precisato che nel caso in cui il contribuente abbia già beneficiato di precedente analoga agevolazione e intenda avvalersi di un'ulteriore rivalutazione delle partecipazioni o dei terreni posseduti: non sarà tenuto al versamento delle rate ancora pendenti della precedente rivalutazione; potrà scomputare l'imposta sostitutiva già versata dall'imposta dovuta per la nuova rivalutazione. Qualora dalla nuova rideterminazione emergesse un minor valore rispetto alla rivalutazione precedente, non sarà però possibile ottenere il rimborso di quanto eventualmente già versato in eccesso.

  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
