RISCOSSIONE CANONI IMMOBILI SEQUESTRATI: è L'AMMINISTRATORE GIUDIZIARIO IL SOGGETTO TENUTO AGLI ADEMPIMENTI IVA


Con il Principio di diritto n. 11 del 31 luglio 2020 l'Agenzia delle Entrate ha chiarito che, relativamente agli adempimenti IVA concernenti la riscossione di canoni relativi ad immobili sequestrati, il soggetto tenuto ad adempiere agli obblighi di fatturazione, registrazione, liquidazione e presentazione della comunicazione delle liquidazioni periodiche e della dichiarazione annuale, in luogo e per conto del locatore, è da individuarsi nell'amministratore giudiziario, per l'intero periodo di affidamento dell'incarico risultante dal provvedimento del giudice. Questo per tre motivi: il titolare dei beni, in attesa della confisca definitiva o della restituzione al proprietario, non è individuato a titolo definitivo e per questo motivo non ha la disponibilità dei medesimi; la veste di soggetto passivo d'imposta spetta a colui che assume, con effetto retroattivo, la titolarità dei beni sequestrati e, quindi, il soggetto passivo d'imposta è individuato a posteriori, seppure con effetto ex tunc, nello Stato o nell'indiziato, a seconda che il procedimento si concluda con la confisca oppure con la restituzione dei beni; l'amministratore giudiziario, in pendenza di sequestro, non assume un'autonoma soggettività d'imposta ma opera nella veste di rappresentante in incertam personam, curando la gestione del patrimonio per conto di un soggetto non ancora individuato.   • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
