Decreto Liquidità convertito in legge: finanziamenti garantiti fino a 30.000 euro per 10 anni e autocertificazione per SACE


Con la conversione in legge del Decreto "Liquidità" arrivano novità: per i prestiti garantiti dal Fondo PMI, l'incremento dell'importo massimo concedibile da 25.000 a 30.000 euro con una durata che passa da 6 a 10 anni. I tassi di interesse applicabili non potranno essere superiori al tasso di Rendistato con durata analoga al finanziamento aumentato dello 0,2%. per le richieste di nuovi finanziamenti garantiti da SACE è prevista l'integrazione dei documenti presentati con una dichiarazione sostitutiva dell'atto di notorietà in cui il titolare o il legale rappresentante dell'impresa dichiari: che l'attività d'impresa è stata limitata o interrotta dall'emergenza epidemiologica Covid-19 o dagli effetti derivanti dalle misure di prevenzione e contenimento connesse alla medesima emergenza, quindi, prima di tale emergenza sussisteva una situazione di continuità aziendale; che i dati aziendali forniti su richiesta dell'intermediario finanziario sono assolutamente veritieri e completi; che il finanziamento coperto dalla garanzia è richiesto per sostenere costi del personale, investimenti o capitale circolante impiegati in stabilimenti produttivi e attività imprenditoriali che sono localizzati in Italia; la consapevolezza che i finanziamenti concedibili da parte della SACE saranno accreditati esclusivamente sul conto corrente dedicato (pertanto i dati relativi saranno indicati); che il titolare o il legale rappresentante istante, nonché i soggetti indicati all'art. 85, commi 1 e 2, del codice delle leggi antimafia e delle misure di prevenzione, di cui al D.Lgs. n. 159/2011 (che individua i soggetti che nell'ambito delle società sono sottoposti alle verifiche antimafia) non si trovano nelle condizioni ostative; che nei confronti del titolare o del legale rappresentante non è intervenuta, negli ultimi 5 anni, alcuna condanna definitiva per reati commessi in violazione delle norme per la repressione dell'evasione fiscale in materia di imposte sui redditi e sul valore aggiunto nei casi in cui sia stata applicata la pena accessoria dell'interdizione dai pubblici uffici per un periodo non inferiore ad un anno e non superiore a tre anni (come previsto dall'art. 12, comma 2, del D.Lgs. n. 74/2000 che dispone la condanna per delitti di dichiarazione fraudolenta mediante uso di fatture o altri documenti per operazioni inesistenti).
